Your Municipality: From National Guidelines to a Working Framework
In April 2025, the Dutch government published the 'Overheidsbrede handreiking Generatieve AI', giving public organisations more room to use generative AI. But a national guideline is not a municipal policy. Your municipality needs its own framework. One that translates broad principles into specific rules your staff can follow daily. This article provides the bridge between the national guidance and your local reality.
What the national guidelines say and what they leave to you
The national guidance establishes principles: transparency, human oversight, proportionality, data protection. It does not prescribe how to apply these principles to your specific municipality's context. Which AI tools are approved for use? Who can use them? For which tasks? Who reviews the output? How are incidents handled? These are the questions your local policy must answer.
VNG (2025): The number of generative AI applications in Dutch government organisations grew from 8 in early 2024 to 81 by early 2025. A tenfold increase. Most municipalities are using AI without a formal policy framework, creating both legal and operational risk.
The seven elements every municipal AI policy needs
| Element | What to Define |
|---|---|
| Scope | Which AI tools are covered, which are excluded, and how new tools enter the framework. |
| Approved use cases | Specific tasks where AI use is permitted, with conditions. |
| Prohibited uses | Applications that are explicitly not allowed (automated decisions about individual citizens without human review). |
| Data rules | What data may be used as AI input, what must be anonymised, what is forbidden. |
| Human oversight | Who reviews AI output before it becomes a municipal communication or decision. |
| Incident protocol | What happens when AI produces an incorrect output that reaches a citizen. |
| Review cycle | How often the policy is updated as technology and regulations evolve. |
| Element | Wat te definiëren |
|---|---|
Lessons from municipalities that got it right
Lessen van gemeenten die het goed deden
Beuningen, Hollands Kroon, and Castricum all published municipal AI policies in 2024–2025. The common thread: they started by defining what employees may not do with AI (enter personal citizen data, make automated decisions without review, use unapproved tools for official communications), then defined what they may do. This negative-first framing proved more effective than aspirational principles, because it gave staff clear boundaries immediately.
