The case for fixing bias in AI is usually made in the language of ethics. That case is real. It is also insufficient, because budget decisions are made in the language of risk, and biased AI is a risk with a price tag. Three price tags, actually. One legal, one reputational, one human. They arrive in that order, and each is larger than the one before it.
Three costs, arriving in order
Drie kostenposten, in volgorde
| Risk | How it materialises | Why it compounds |
|---|---|---|
| Legal | Discrimination claims, regulator scrutiny, EU AI Act enforcement from August 2026 for high-risk deployers. | Every automated decision multiplies exposure. One biased rule, applied ten thousand times, is ten thousand potential claims. |
| Reputational | One documented case of algorithmic discrimination becomes the story attached to your name for years. | Trust is asymmetric. It takes years to earn and one headline to lose, and the headline outlives the fix. |
| Human | Real people denied jobs, loans, benefits, or permits for reasons that were never true. | This is the cost that motivates the first two. Courts and journalists act because someone was harmed. |
| Vertrouwen is asymmetrisch.
The Netherlands does not need this explained in the abstract. The childcare benefits scandal showed what happens when automated risk-scoring goes wrong at scale: families ruined, a cabinet fallen, and a public trust deficit that Dutch institutions are still paying down. No AI business case written in this country should pretend that scenario is theoretical.
The upside case nobody makes
De positieve kant die niemand belicht
Risk avoidance is only half the argument. The other half is a market gap hiding in plain sight.
PwC's 2024 Trust in AI Survey found 72 percent of customers are more likely to continue using a service from an organisation they believe uses AI responsibly. Only 38 percent could name one they trusted. That gap between demand and supply is an open position, and almost nobody is filling it.
Read those two numbers together. Nearly three quarters of the market wants to reward responsible AI. Barely a third can point to anyone deserving the reward. The organisation that can demonstrate, with evidence, that its systems are tested for bias is not doing charity. It is claiming an unclaimed position.
There is an internal audience for this evidence as well. Your own employees watch how the organisation handles AI, and they draw conclusions about whether it can be trusted with their data, their evaluations, their futures. Gartner found employees with meaningful input into AI use show 2.3 times higher voluntary adoption. Fairness work and adoption work turn out to be the same work. An organisation seen to test its systems honestly gets systems people are willing to use.
What the business case looks like on paper
Hoe de businesscase er op papier uitziet
A bias audit costs a fraction of a discrimination claim. Ongoing output monitoring costs a fraction of a scandal. And documented fairness testing is precisely the kind of evidence the EU AI Act's deployer obligations will expect from August 2026 onward. The controls you build voluntarily this year are the controls you will be required to show next year. Building early is not virtue. It is sequencing.
Put it to your board in one sentence. We can pay for fairness testing now, on our schedule, or pay for its absence later, on someone else's.
And keep the sequencing honest in your own planning. Gartner found 85 percent of failed AI projects fail on use case selection, not technology. A use case chosen without asking who could be harmed by a wrong answer is a use case selected badly. Adding that single question to your intake process costs nothing and quietly filters out the projects most likely to produce all three costs at once.
