De deontologische blik op AI: regels, plichten en de grenzen die u niet overschrijdt The Deontological Lens on AI: Rules, Duties, and the Lines You Do Not Cross

Some things are wrong even when they work. That sentence is the whole of deontology, and it is the exact thing a utilitarian spreadsheet cannot express. An AI that improves outcomes by quietly violating a person's rights has not made an acceptable trade in this view. It has done something forbidden that happened to pay. Where the previous framework asks did it produce the most good, this one asks a colder question first: were we even allowed to do it?

Duties come before outcomes

Plichten gaan voor uitkomsten

Deontology, most associated with Kant, holds that morality is a matter of duties and rights that hold regardless of consequences. You do not lie, even when a lie would help. You do not use a person merely as a means to someone else's end, even a good end. Translate that into AI and it becomes a set of hard constraints: things the system may not do to a person no matter how much the outcome improves.

This is not an abstract stance. It is written into law. The AVG's requirement of a legal basis before processing personal data is deontological to its core: it does not ask whether the processing would be useful. It asks whether you have the right. The EU AI Act's outright prohibition of certain practices, like social scoring, says the same thing louder. Some uses are off the table, full stop, whatever the benefit.

The EU AI Act, in force since August 2024, does not weigh the benefits of prohibited practices against their harms. It bans them. That is deontology as legislation: a line drawn before the cost-benefit conversation can even begin.

The strength, and the wall it runs into

The strength is obvious once you have seen a utilitarian system industrialise a small unfairness. Deontology is the framework that says: it does not matter that the averages improved, this person had a right you violated, and the right wins. It protects the individual the spreadsheet averages away. For anything touching fundamental rights, a benefits decision, a fraud flag, a medical judgement, that protection is not optional. It is the point.

Now the wall. Rules conflict. A duty to be transparent can collide with a duty to protect security. A duty to treat everyone identically can collide with a duty to accommodate genuine difference. Deontology tells you which actions are forbidden, but when two permitted options remain, or two duties point opposite ways, it often falls quiet. It draws walls beautifully. It is less good at telling you where to walk between them.

Nu de muur. Regels botsen.

So deontology and utilitarianism are not rivals so much as halves. One draws the walls. The other optimises inside them. An organisation using only the first is safe and often stuck. Using only the second is efficient and occasionally monstrous. The interesting frameworks are the ones that try to hold both at once.

Walls without a path are still worth having. They are just not the whole map.

Where are your lines drawn?
